Terms of Service

1. Agreement to Terms

By downloading, installing, or using Ticked ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Ticked ("we," "us," or "our").

2. Description of Service

Ticked is a habit tracking application for iOS devices that allows users to:

  • Create and manage personal habits
  • Track daily and weekly habit completions
  • View streaks and progress statistics
  • Sync data across devices using iCloud
  • Receive reminders and notifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Eligibility

You must be at least 13 years old to use Ticked. By using the App, you represent that you meet this age requirement.

If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have read and agree to these Terms.

4. Account and Data

Ticked uses your Apple ID and iCloud account for data storage and synchronization. You are responsible for:

  • Maintaining the security of your Apple ID
  • All activities that occur under your account
  • Ensuring your iCloud account has sufficient storage
  • Backing up any data you wish to preserve

We are not responsible for any loss of data due to iCloud issues, device problems, or your failure to maintain backups.

5. Subscriptions and Payments

5.1 Free and Pro Tiers

Ticked offers a free tier with limited features and a paid "Ticked Pro" subscription with additional features.

5.2 Subscription Terms

  • Subscriptions are billed through your Apple ID account
  • Payment is charged at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your Apple ID account settings

5.3 Free Trials

If we offer a free trial:

  • The trial begins when you start it and lasts for the specified period
  • You will be charged the subscription fee at the end of the trial unless you cancel
  • Unused portions of free trials are forfeited when you purchase a subscription

5.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple according to their refund policy. We do not process refunds directly.

6. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App to transmit harmful code or malware
  • Interfere with or disrupt the App or servers
  • Violate any applicable laws or regulations

7. Intellectual Property

The App and its original content, features, and functionality are owned by Ticked and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes subject to these Terms.

You retain ownership of any content you create within the App (such as habit names and data).

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Ticked is a habit tracking tool and does not provide medical, health, fitness, or professional advice. Consult appropriate professionals for such advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TICKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data
  • Loss of profits
  • Loss of goodwill
  • Service interruption
  • Computer damage or system failure

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Ticked and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

  • Your right to use the App ceases immediately
  • We are not obligated to retain your data
  • Provisions that by their nature should survive termination will survive

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting updated Terms on our website
  • Updating the "Last updated" date
  • Sending an in-app notification for significant changes

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Poland.
